2. Legal bases
Your personal data, including data transmission to third parties, will only be effected if there is a legal basis therefore. In accordance with the GDPR, three regulations in particular here come into consideration:
- You have provided us with your consent to process your data for one or more purposes, Art. 6 (1)(1)(a) GDPR.
- The processing of your data is necessary for the fulfillment of a contract or for the implementation of pre-contractual measures with you, Art. 6 (1)(1)(b) GDPR.
- The processing of your data is required in order to protect our legitimate interests and those of third parties, unless your interests or fundamental rights and freedoms prevail, in particular if it concerns a child, Art. 6 (1)(1)(f) GDPR.
The relevant provisions in the Hessisches Schulgesetz (HSchG, Education Act of Hesse) and the Hessisches Hochschulgesetz (HHG, Higher Education Act of Hesse) are also to be observed.
We shall point out to you at the respective points on which legal foundations the processing of your personal data is based.
3. Data transmission
As previously mentioned, your personal data will only be transferred to third parties if there is a legal basis therefore.
Data is only transferred to countries outside the EU or the EEA (so-called third countries) if this is required for the fulfillment of contractual obligations, is required by law, you have submitted your consent or in the context of order processing. If service providers are used in third countries, they are obliged to comply with the requirements of the EU standard contractual clauses on data protection within the EU.
4. Storage duration
We only process and store your personal data for as long as required for the fulfillment of the purpose pursued. After dropping of the processing purpose or after expiry of statutory retention periods or in the case of the revocation of your once granted consent (if the data processing is based on it), we will delete your personal data or anonymize them. After the anonymization, they cannot be used to identify you.
5. Automated decision making
We do not make use of fully automated decision making including profiling in the sense of Art. 22 GDPR for the purposes mentioned below. Should we use these procedures in individual cases, we will provide separate information, insofar as this is required by law.
6. Rights
You have a right of data access (Art. 15 GDPR) as well as a right to rectification (Art. 16 GDPR), to erasure (Art. 17 GDPR), to restriction of processing (Art. 18 GDPR), to data portability (Art. 20 GDPR), to object (Art. 21 GDPR), and to lodge a complaint with the supervisory authority (Art. 77 GDPR), the Hessian Commissioner for Data Protection and Freedom of Information (https://datenschutz.hessen.de/).
At any time, you may change or revoke in full your consent without providing reasons with effect for the future. You may send your requirements to the data protection officer as a free-form request.
7. Collection and processing
7.1 Accessing our websites
When you access our websites, your browser automatically sends information to the server of our websites. This information is stored in a server log file with our web space provider. Among other things, the following information is recorded without further action on your part: IP address of the requesting computer, if applicable in pseudonymized form, date and time of access, name and URL of the accessed file, transferred data volume, access status (file transferred, file not found etc.), access mode (GET, POST), website from which access is made (referrer URL), browser used together with version, operating system of your computer and name of your access provider.
The legal basis for processing the aforementioned access data is our legitimate interest in the following tasks: optimization of the information provided, evaluation of system security and stability, statistical evaluation and examination in the event of suspicion of illegal use of our websites. For our legitimate interests, we also use a hosting provider, as this ensures the efficient operation of our online offers, including e-mail delivery.
Our websites use SSL encryption to protect the transmission of confidential content. At this point, however, we would like to point out the general dangers of internet use, including email traffic, over which we have no control. Furthermore, we would like to point out that our websites may also contain content, services and offerings of other providers that supplement what we offer. Accessing these services from third parties requires the transmission of access data such as your IP address. In this context, please also note the special terms of use and data protection declarations for individual third-party providers and service providers whose services we use on our websites.
7.2 Online forms and email contact
We provide you with contact and admission forms on our websites in order that you can contact us at any time to express your interest in our educational offerings. To use the forms, we require your name for a personal form of address and a valid email address to contact you, in order that we know who sent the request and can process it. The same applies to contact through you by email.
The online forms are created using 123FormBuilder (https://www.123formbuilder.com/de/datenschutzrichtlinie/) or Freshworks (https://www.freshworks.com). To do this, the data you enter in the form or survey will be forwarded to 123FormBuilder's or Freshworks servers and stored in our user account. As part of the user account, we can view and evaluate the forms directly. 123FormBuilder or Freshworks itself has no access to this data.
The data transmitted to us in this way, such as your name, your email address, your address, your telephone number and your request, are used exclusively for the purpose for which you make them available to us. The processing takes place here for the initiation and execution of a contract and the use of 123FormBuilder or Freshworks in our legitimate interests in the effective processing of your requests.
7.3 Newsletter
We will only send you a newsletter if you order it from us or express your interest in our educational offerings. This processing takes place for the initiation and execution of a contract or in our legitimate interests in the provision of information. The contents of the newsletter in general cover information about our educational or higher educational programs and information events. You only need to provide your email address in order to register for the newsletter. If you provide further voluntary information, such as your name, these can be used to personalize the newsletter addressed to you.
For security reasons we use the so-called Double-Opt-In procedure for the registration to our newsletter. After your registration you will therefore receive an email requesting you to confirm your registration. Only with the confirmation of the registration this becomes effective. Furthermore, your registration for the newsletter will be logged.
You can unsubscribe from our newsletter at any time by clicking on the link provided at the end of each newsletter or by sending us an email.
We use either CleverReach (https://www.cleverreach.com/de/funktionen/datenschutz-sicherheit/eu-dsgvo/), an email tool that processes the information you provide, or Freshworks (see subsection 7.5.) in order to send you our newsletter. The use is based on our legitimate interests. We are interested in using a user-friendly and secure newsletter system that serves our business interests and meets your expectations.
7.4 Alumni
Within the framework of the alumni networking, we process the data provided by you. We use your data exclusively for the maintaining contacts between alumni and university or school. In addition to invitations and information (e.g. newsletter), the maintenance of contact with alumni also includes offers to become involved as alumni (e.g. to accompany university or school students, as mentors, speakers or scholarship providers). The legal basis for this data processing is your consent.
7.5 Applicants: preschool, school or university place and employment
In the context of the application and admissions procedure, we process the data provided by you. Without this data we are not able to consider your application or registration. The legal basis for this data processing is the implementation of pre-contractual measures.
Only those who are involved in the implementation of the application or admission process will have access to your personal data.
For the application procedure and related email correspondence at the accadis Hochschule Bad Homburg, we use the customer relationship management (CRM) system Freshworks (https://www.freshworks.com) to process inquiries from prospective students faster and more efficiently. Full Fabric uses the user data only for the technical processing of inquiries. (When assigning the preschool and school places as well as selecting employees, the procedure takes place without the employment of a CRM system.) In suitable cases, we use SignRequest (https://signrequest.com/) for the digital signature of documents. SignRequest uses the data of the users such as name and email address. The use of these services is based on our legitimate interests.
7.6 Other groups of persons
Information on the processing of the data of children, school students and parents as well as of students and employees can be found in the privacy policy enclosed with the respective contract.
8. Third party services
By using our websites, you agree to the terms of use of the services listed below. The use of these services on some of our websites is based on our legitimate interests.
8.1 Social networks
We have links (buttons) to social networks such as Facebook, Instagram, LinkedIn, Twitter and YouTube on our websites. These links are marked with the logo of the respective social network. As long as these links are not clicked, no data will be transmitted to the social networks. Only when you click on the links and thereby declare your consent to communication with the servers of the social network, the links become active and the connection is established.
The social network is provided with information about the page you visit, which you can share with your contacts on your social network. If you want to share the information, you must be logged in. If you are not logged in, you will be taken to the login page of the social network you clicked on, and you will no longer be on our websites. Once you are logged in, the information will be sent that you would like to recommend the respective article. By activating the link, the social networks then also receive information that and when you have called up the corresponding page of our internet presence, as well as, for example, your IP address, information about the browser used and the language settings.
8.2 YouTube videos
YouTube videos that can be played directly from our websites are stored on YouTube's server. Only when you play the videos will user data such as your IP address be transmitted. By visiting the website, YouTube receives the information that you have accessed the corresponding subpage of our websites. This is independent of whether YouTube provides a user account through which you are logged in or whether no user account exists. If you are logged in to Google, your information will be directly associated with your account.
If you do not wish to be associated with your profile on YouTube, you must log out before activating the button. YouTube stores your data as user profiles and uses them for purposes of advertising, market research and/or demand-oriented design of its website. Such evaluation takes place in particular (even for unlogged-in users) to provide demand-oriented advertising and to inform other users of the social network about your activities on our websites. You have the right to object to the creation of these user profiles, whereby you must contact YouTube to exercise this right.
8.3 Google Maps
Our websites uses the Google Maps API to help you identify our location and better plan your visit to our site. By using Google Maps, information about your use of the website (including your IP address) may be transmitted to and stored by Google on servers in the United States.
You can disable the Google Maps service to prevent data transfer to Google. All you have to do is deactivate JavaScript in your browser. In this case, no data is transferred, but you can no longer use the map display on our websites.
8.4 Bing Custom Search
Within our internet offering the user-defined search of Google, Bing Custom Search (https://customsearch.ai) is used as the central search service. The integrated search service enables a full-text search for the contents of our internet offering. This search function can be accessed via an integrated search field.
If you do not wish Bing Custom Search to collect and use your data, please do not use the search field. Data will only be transmitted if a request is sent via the search field.
8.5 Google Fonts
On our websites we use Google Fonts (https://fonts.google.com/about) to make reading our websites easier and graphically more pleasant. These web fonts are integrated by a server call, usually a Google server in the USA. This may result in the following being transmitted to the server and stored by Google: name and version of the browser used, website from which the request was triggered, user's operating system, user's screen resolution, user's IP address and language settings of the browser or operating system.
8.6 Google Meet
Video conferencing systems can be used in in-class lessons. For this we use Google Meet (https://apps.google.com/meet/). Real-time transmission of video and audio allows either all students to meet digitally or individual students to join the class. Students can follow and actively participate in what is happening in class by watching, listening, and participating in discussions as appropriate. There is no provision for recording the video transmission or transmitting it to third parties.
8.7 Matomo (ehemals Piwik)
This website uses the open source web analytics service Matomo. Matomo uses technologies that allow cross-page recognition of the user in order to analyze user behavior (e.g. cookies or device fingerprinting). The information collected by Matomo about the use of this website is stored on our server. The IP address is anonymized before storage.
With the help of Matomo, we are able to collect and analyze data about the use of our website by website visitors. This allows us to determine, among other things, when which page views were made and from which region they originate. We also collect various log files (e.g. IP address, referrer, browsers and operating systems used) and can gauge whether our website visitors perform certain actions (e.g. clicks, purchases, etc.).
The use of this analysis tool is based on Art. 6, Sec.1 (f) GDPR. The operator of the website has a legitimate interest in the anonymized analysis of user behavior in order to optimize both its website and its advertising. Insofar as a corresponding consent has been requested (e.g. consent to store cookies), the processing is carried out exclusively on the basis of Art. 6, Sec. 1 ( a) GDPR. Consent can be revoked at any time.
IP anonymization
When analyzing with Matomo, we use IP anonymization. In this case, your IP address is abbreviated before analysis so that it can no longer be clearly assigned to you.
Hosting
We host Matomo with the hosting provider Mittwald CM Service GmbH & Co. KG, Königsberger Straße 4-6, 32339 Espelkamp. We have concluded an commissioned data processing contract with the hosting provider.
9. Photographs and Video Recordings during Events
Please note that photographs, sound recordings and film recordings may be made in the course of our events. These recordings are associated with the pictorial portrayal of persons attending the event, whereby the selection of persons is more or less random. Use of the images for reporting and/or advertising purposes may occur on our websites, social media channels, print media, posters, video clips and other media. Upon entering the event grounds as well as the event rooms, your consent is given to the publication in the aforementioned manner, unlimited in time and space and free of charge, and without the need for an explicit declaration from you.
If you do not agree with the publication of pictures of yourself, please inform Guest Services immediately at the beginning of the event. You will then be assigned special seats. You can revoke this consent at any time.
10. Update of Data Protection Regulations
As new technologies and the continuous development of our websites may result in changes to this privacy policy, we recommend that you read the privacy policy again at regular intervals.
When in doubt regarding questions of interpretation, the German version of this privacy policy shall apply.
